Dr. Dre Loses Trademark Battle Against OB/GYN Dr. Drai

Hip-hop super-producer Dr. Dre lost a dispute to a Pennsylvania-based gynecologist who was trying to get the name Dr. Drai trademarked according to BBC News.

Dr. Dre born Andre Young filed a complaint against the gynecologist, Draion M. Burch, in 2015 claiming that the doctor’s “Dr. Drai” nickname would confuse consumers, as Burch planned to sell audiobooks and web seminars using the byname. The US Patent and Trademark Office ruled to dismiss the case after Young failed to prove how only the similarity in names would mislead a consumer,

Burch stated that he was never trying to benefit from Young’s reputation as that would be “a bad reflection on [him] as a doctor” due to the misogyny and homophobia throughout Dr. Dre’s lyrics. The gynecologist also argued that there would be no confusion in the marketplace “because Dr. Dre is not a medical doctor nor is he qualified to provide any type of medical services or sell products specifically in the medical or healthcare industry.”

The US trademark office agreed with Bruch who authored the book 20 Things You May Not Know About the Vagina and who hosts web seminars along the same lines. They also claimed it would be hard for a consumer to mistakenly purchase a product from Dr. Drai when he charges $5,000 for speaking engagements.
